A WORKER at Next who stormed out of the store never to return has lost her claim of unfair dismissal.
Samantha Holliday was employed as a part-time ’stock replenisher’ at the Queen Street clothing store between November 2003 and September last year. But she walked out when the store manager decided to discipline her following a customer complaint. Mrs Holliday took her case to the Employment Tribunal, claiming constructive unfair dismissal and arguing that the store had failed to give her a copy of her contract. After reading evidence submitted to the tribunal by her former employer, Mrs Holliday felt unable to continue her case but the hearing had to go ahead because she had not let the tribunal know in writing.
