Clamping subject to new law?

00535934_cropped.jpgWHEEL-clampers may soon be facing regulation as a result of a JEP Fair Play campaign which highlighted allegedly heavy-handed methods and questioned the legality of wheel-clamping.

Action on these issues was promised by Home Affairs Minister Wendy Kinnard following the campaign and a meeting between her department and Fair Play, and it has resulted in the issue of a consultation Green Paper by the Senator.

One of the main aims of the paper is to gauge public opinion on wheel-clamping and to see whether it needs regulating. Late last year, the Fair Play campaign fought on behalf of Islanders for action over the non-regulation of the private parking enforcement companies.

The consumer column also exposed the fact that there is no clear legal position on the practice and reported on how people said they had been disgusted by the arrogance and rudeness of the clampers and claimed that they suffered intimidation and abusive behaviour.

    You park on someone elses property or parking space you pay the fine. All i hear is people complaining about how they have been treated when They should not be parking in other spaces or land as they know they are in the wrong!

    MY CAR GOT CLAMPED ON A SUNDAY NIGHT AT 7.30PM
    WHILE I WAS JUST BUYING A TAKE AWAY COFFEE AT THE BEAN AROUND THE WORLD, WITHIN 3 MINUTES MY CAR GOT CLAMPED AND THE BIG FAT GUY WOULDN’T LET IT GO!I WASN’T BOTHERING ANYONE AT ALL BUT YET HAD TO GIVE £150.00 TO GET MY CAR RELEASED !!!
    THIS IS A TOTAL JOKE…

    I am sorry you got clamped but where were you parking? If parking is left un-controled and not policed either by clampers or the Police themselves then we would have total chaos on our streets in town. Just look around town at 5 pm onwards, all the yellow lines are parked on and people park in the most stupid places but they know that as long as they dont block the road thier are no parking wardens on duty. As for private land well i support any land owner who calls in the clampers. So back to my first question: Where were you parked Paul? as i bet you were on private land.

    Obviously the fine is a punitive amount to discourage people from parking illegally and the clamp is designed to ensure you pay. If you particularly wanted to spite a clamper I suppose you could give the equivalent amount of money to a mechanic to arc weld it off, however I’m left wondering if we didn’t have clamping whether an even more severe punishment might be put in its place? I’m with Mark, it’s illegal to park on Private land and people and criminals should be punished.

    I agree that cars parking illegally should be fined but i also think that you should be able to stop for 10 minutes on the side of the road. It’s absolutely outragious charging £150 for a vehicle thats only been parked for 3 minutes while someone nips into a shop - i mean you cant expect the majority of us to spend 20 minutes hunting for a car space, a further 10 minutes walking to where you have to go - not to mention the paycards - i definately think staying for 10 minutes should be allowed.

    When someone parks in my space or blocks my door i leave them a note in the windscreen advising them its illegal to park there and if they park there again for longer than 20 minutes i call the authorities… but at least give people a warning before clamping them

    having a couple of parking spaces on the outskirts of town which are rented out to tenants living in the building where the parking spaces are we have to police these spaces if not anyone can & will use them with out regard, if you park somewhere that you should not then you are taking a chance it its your choice but if you get clamped then don’t complain about it you were wrong get over it & pay the fine,

    You have the choice where to park, take a chance & may be get a fine or find some a parking space, we have the same situation on commercial unloading bays they are for commercial vehicles not private cars they are policed by the traffic wardens (public sector) clamps are the same but for the private sector,

    If you don’t like the idea of getting clamped don’t park in the wrong place, simple.
