Company fined £8,000 for town hotel site danger

DEVELOPERS who endangered the safety of workmen and members of the public at the former Town Park Hotel sight have been fined £8,000 by the Royal Court.

Malco Developments Ltd, who were represented in court yesterday by company director James Patterson, admitted the breach of the Health and Safety at Work Law.

The company was also ordered to pay costs of £2,000.Advocate Nina Benest, defending, asked that her client be allowed to pay in instalments because of cash flow problems.

She then revealed that the relatively small family had already lost £325,000 on the Town Park Hotel project and stood to lose an additional £149,000.The charges related to the period 27 to 29 April 2002, when sub-contractors employed by Malco to excavate the site dug too close to the wall of 24 Lewis Street, the Occupational Therapy Centre, making it liable to fall down.Crown Advocate Conrad Yates said that agents of Malco should have been on site to make sure that the sub- contractors excavated according to the plan and did not undermine any foundations.The advocate told the Inferior Number that this was a ‘one-off and that her clients had an unblemished record with regard to health and safety.The Bailiff, Sir Philip Bailhache, was sitting with Jurats Quérée and Tibbo.
