Guernsey ‘had power to bar Jersey fishermen’

THE Guernsey States did not go beyond its power by barring Jersey and UK boats from fishing in Guernsey waters, it was claimed in Guernsey’s Royal Court on Friday.

And the legal challenge to the Guernsey Sea Fisheries Licensing Scheme by the Jersey Fishermen’s Association has been adjourned once again to 26 February.Guernsey Crown Advocate Richard McMahon said that the the challenge by Jersey and UK fishermen amounted to a legal challenge to the new restricted licensing scheme within Guernsey’s 12-mile limit and that their counsel, Advocate Gordon Dawes, had accused the States of Guernsey of going too far in legislating from three to 12 miles.Advocate McMahon added that under European Law it was ‘abundantly clear that the enabling power has not been exceeded’.
