Battle of Toulouse could reach court
Friday 9th September 2005, 12:00AM BST.
FROM the washroom to the courtroom – the battle of the Broad Street loos is heading towards a judge.
The Town Hall is seeking a judicial review to help open the new café on the site.
The shutters on the Toulouse Café in the former men’s convenience have remained down because Health and Social Services insist that a staff toilet should be installed before it can open – all such facilities were removed to make way for kitchen and storage equipment.
But the Town Hall and the new café’s management say that exceptions to the health protection department policy exist all over the Island – from ice cream vans to beach concessions and other cafés.
Faced with Health’s refusal to back down, the Constable, Simon Crowcroft, was today making his next move to get the centrepiece of the Broad Street revitalisation programme up and running.
He wants the Royal Court to decide.
‘I think this requires a judicial review of the decision.
I think the treatment of the proprietor, Sean Murphy, has been grossly unfair,’ said the Constable.
