Trust transfer delayed over ‘suspicious’ funds

THE Royal Court agreed yesterday to delay by six months the transfer of trust assets to a divorced woman because of suspicions that the funds could be linked to international criminal activity.
This week’s hearing follows a decision last year in the English High Court of Justice, which found that Jersey-registered Fountain Trust was a ‘sham’ which had been set up to conceal the resources of the settlor, Darays Cyrus Minwalla, in particular from his fourth wife.
The trustees, CI Law Trust and Folio Trust Company Ltd, were ordered to transfer assets of £4.1 million to the wife, Meher Darays Minwalla.
Jersey’s Royal Court has agreed to enforce the English decision, even though the judges applied English law rather than Jersey law.
Nevertheless, the transfer of funds remains subject to submissions from the government of Pakistan and the Island’s Attorney General, on behalf of the States of Jersey police.
