Holidays: Sort out your workers’ time off in lieu, employers are urged

ALL employers of shift workers are being urged to put down in writing their rules on bank holiday time.

The Island’s Employment Tribunal has delivered its first ruling on an employee whose day off fell on a bank holiday and was not given time in lieu.

During that ruling, the tribunal suggested that all employers sort out the issue before more people fall foul of the law.

The case involved Gaudencia Mila, who worked for G4S Security Services (Jersey) Ltd as a first response officer.

His work pattern involved working a series of days on and then a rest day.

Last year his rest day fell on Christmas Day, so he missed out on receiving a day in lieu or double pay.

He argued that that was unfair.

His employers said that they were following the law, but admitted that it was open to interpretation
