Sheep farmer wins battle – at a price
Saturday 29th November 2008, 9:57AM GMT.
A LANDMARK court ruling has upheld a sheep farmer’s right to build a cottage in her St Lawrence field – but left her with a £6,000 bill.
In the first-ever third party planning appeal case to go to the Royal Court, Jenni Riggall has been given the final backing in her five-year battle to build a cottage to run her farm.
The new third party planning appeals system allows neighbours of a development to object in court after planning permission has been given.
In the Royal Court on Thursday, the appeal was dismissed, but Miss Riggall was ordered to pay the costs. It was argued in court that if appellants could be made to pay, no one would use the procedure for fear of running up a huge bill.
