How to save our coast? Make them obey the law

I WRITE to express support for the National Trust for Jersey’s campaign to protect our precious coastline.

In so doing, I would like to draw attention to two documents that are relevant to the campaign. The first is the policy document of the Island Plan and the second is the Planning and Building (Jersey) Law 2002.

The Island Plan, being a general policy statement, has to take second place to the primary law as approved by the Queen in Council, and that law sets out the purposes of the law in article 2. Furthermore, sub-paragraph (2) sets out the intention of the law, and sub-paragraph (d) states: ‘… to ensure that the coast of Jersey is kept in its natural state.’

It is my opinion that this article in the Planning Law must be taken into account when any application for development on the coast is considered. The Island Plan should be subservient to it.

The best way to safeguard our beautiful and precious coast is to bring the relevant article of the Planning and Building Law to the fore and abide by it. After all, it is the law.
