A SENIOR UK superintendent walked out of the States police less than a week into the job after realising he had entered ‘the eye of a storm’, the Home Affairs Minister has claimed.

Senator Ian Le Marquand believes that the officer was put off by ‘vicious and scurrilous’ attacks on police officers on some of the Island’s internet blog sites.

Now the minister fears that such attacks could have a major impact on the recruitment of ‘high quality’ employees from outside the Island.

The UK superintendent was recruited to replace detective superintendent Mick Gradwell, the senior investigating officer in the historical abuse inquiry, but it is understood that he left within four days of his appointment at the beginning of March.

    I would suggest that any police officer not capable of withstanding a bit of name calling is not suited to the position.

    Hopefully the bobbies on the beat are made of sterner stuff, some of our hardened criminal fraternity have been known in extreme ciscumstances to resort to name calling if cornered.

    Perhaps we need to employ some type of super bobby who can withstand the attacks, what about a deaf copper.Ok there fre inherent problems but if he were placed at the vanguard of the attack to shield the other officers…

    If that’s the case then introduce legislation to start cracking down on them. Internet Blogs are a law upon themselves at the moment and Syvret is probably the worst culprit of the lot yet the States seem to not do a thing about it.

They have been sprouting the same old cover up cobblers for 2 years and out of all of Syvret’s ill informed allegations against others nobody has been charged to date and whilst he continues pointing the ill informed finger at people nobody ever will. His linked blog Voices of Children comes out with similar rubbish about Haut de la Garenne and then trades insults with any politicion who disagrees with their little ill informed niche. Jersey Blogs are rubbish so this Superintendant must of been plain stupid to take any notice of them because nobody else does!

    So a superintendent who would have had to move to the island as well, quits after a few days because OTHER officers were being slated on web sites?
    Can we know which web sites these are? Im not aware of any sites you can go to and blog about police officers. Im sure I could do it in any forum but a site that the police actually monitor?
    I have heard there is a culture of bullying in the Jersey police force. Could he have seen how badly the officers operate together and packed it in?
    I think there is a lot more to this story than is in the public domain. non-sense

    A senior policeman who runs away from a job because of things said on a blog- I really very much doubt it! More like he realised that there is a huge can of worms that is waiting to burst open and he didn’t want to be any part of it. I know some people want to blame Stuart Syvret for everything but I think this is a little bit far-fetched.If however this is the reason why the policeman quit so rapidly I would say Jersey is better off without him as he must be pretty spineless.

He probably got over here after watching Lenny Harper’s umpteen television interviews about a house of horrors and murder scene and thought he was taking over a really exciting case. Then he found out about restraining bed springs,shackles made of 1950’s guttering, coconut skulls and land fill containing milk teeth from the 1600′s and then thought like the rest of us, “what a mess”

    In the paper edition it is stated that the job was not what he was expecting and that was at least part of the reason for him leaving.
    Senator Ian le Marquand should try leafing through Private Eye or The Sun.
    Jersey politicians and Civil Servants get an incredibly easy ride compared with their mainland counterparts from the local media and blogs.
    What do they expect?
    No criticism at all!

    I fully agree that the issue of cyber bullying and internet blogging is a source of major concern. But an bigger concern is the curtailment of free speech. People should be able to say what they like, no matter how offensive. Should laws be brought into stop free speech we shall be a much poorer society for it. I would rather hear what even offensive people have to say than have them gagged and thier vile thoughts pushed underground. It’s not quite Burma yet, is it ?

    I am aware of the viscious attacks that have been played out in the mainstream media, instigated by Mr Gradwell and others, against Mr Harper and more recently against Mr Power. However, I am not aware of any blogs that have done this.
    With such unprecedented criticism of the police played out so publically I am not in the least bit suprised that the officer in question went home.
    The Gradwell TV interviews were a total disgrace and Mr Le Marquand’s recent radio interviews are also highly questionable. He really should know better.
    It sounds to me that someone is trying to deflect the blame for this PR fiasco.
    Public confidence. which has taken a nose dive since the suspension of the Chief of Police, is now in tatters.
    It is these malicious statements as reported in the mainstream media that are the root cause. Most people have not got a clue what is being said on the blogosphere.

    Senator Le Marquand.’thinks’ that island blogs are a reason that the new senior police officer left? Isn’t he supposed to be a lawyer dealing with hard facts? Did he not check with said officer that this was a primary reason?

    Did the officer not check conditions here first before coming- how many staff he would he have etc? Its all so unprofessional it calls into question the Minister’s competence. As did his remark yesterday that 65 childrens’ teeth fell through cracks in the floorboards.

    Syvret will never come back because as a bankrupt due to the choice (not his) of the most expensive opposition possible, in court , a denial of ‘public interest defence’ as he sees it, but is then interpreted by the magistrate who had to get into his mind to make the judgement as to it being a non-admissable defence…..
    However if you are Curtis Warren convicted drug dealer etc you get the exact same legal operative as defence and the public pay for it.

    Freedom of speech but as long as people will put their money where their mouth is and supply back up evidence to prove it is true so that they can be sued if need be. Something we all understand to be an action Stuart Syvret has never delivered upon when asked to do so several times by the States. I think thats the main issue here. Its too easy to go onto a blog, facebook or even youtube and spread slanderous rumors about people. But for gods sake back it up when you are asked to do so!

    I am told that morale at the Kremlin is abysmal and have heard friends in S.o.J.P. refer to the Rouge Bouillon as ‘Fawlty Towers’. Clearly David Warcup couldn’t convince the senior Detective that things were going well in the job – he has got a hard job as the force has been hemorahaging insofar as experience is concerned. The short term visitor probably found it would be hard to make a silk purse out of a sow’s ear.

    It is simply not credible that an experienced, senior police officer would leave his post in the police service after only four days because he might be criticised on a blog.

    Much more likely and credible is that he arrived in Jersey and very quickly found how dysfunctional and professionally dangerous a place it is to work and got out as quickly as possible.

    The Minister should realise that this tells us more about the state of Jersey public service than any negative publicity that might appear on an internet blog.

    I’d also concur with the views expressed by a number of commentators about Le Marquand’s sloppy investigation of this. Surely something as serious as a senior officer leaving an already troubled police force after such a short period of time would warrant a proper inquiry, exit interview etc, not some suppositions made to suit the establishments spin.

    I would be very surprised if a high ranking police officer ran away because of vicious attacks on blogs but some of these regular posters who are named and should be investigated by the police even just for becoming a nuisance and irritant towards other people. The escapees from the asylum will never win this war so don’t believe it. I am looking forward to the final outcome of the Wiltshire Report and now this so called ACPO scandal which I found really amusing to hear. One of the bloggers sounded really desperate on the radio today, calling up every day now and defending ACPO! I mean claiming everything is a conspriracy, a cover up, a set up and still claiming teeth belong to an un named missing persom! You know the usual desperate claims from a side that has almost certainly lost the fight now together with the war! It was like a Voice of Desperation and its getting funnier every day. Keep up the good work Senator Le Marquand. You obtained a land slide victory in the last elections and thats because you are honest and your record stands out. An ex magistrate will always be taken more seriously than any unemployed blogger. Its not even debatable!

    Its all too pathetic to take seriously … and as far as Le Marquand trying to blame public internet blogs for this lame guy leaving after 4 days is insulting to the public who have a right to their view …. freedom of speech is still free even though of course the Ministers want to restrict that as well now by trying to scare people into not saying what they think! You can say things as long as the authorities allow you to!
    Le Marquand … dont blame the public for exterting their right to free speech and free opinion but try looking closer at the way the police are run! That will probably be the real reason this copper ran a mile so soon!

    Having followed carefully the saga of Graham Power’s suspension and the way he has subsequently been treated, I myself, as a retired UK police officer, would rebuff any attempt to persuade me to work for the States Police and I suspect that the Superintendent in question realised just what he was walking into.

    Set aside all the political manouvering and condider this. Has Graham Power been treated fairly and in accord with his basic human rights? Looking at what went on at the two “suspension review” hearings, clearly not. If the Jersey government can treat Mr. Power in that unjust way, then all government employees in Jersey risk, in approprioate circumstances, similar treatment. That is hardly an advert for filling vacancies at any level.

    This has nothing to do with police officers being subjected to name calling. If you think that’s bad in Jersey then ask police officers who work the inner cities of mainland UK what its like. No, it is simply a question of not wanting to work for an organisation that does not believe in treating its staff in an appropriate way and moreover, ensuring that they are treated fairly.

    There are several things to consider when discussing the States of Jersey Police. Firstly the troops on the ground floor do by in large an excellent job. Jersey is a small island where everyone knows everyone elses business and seem hell bent on spreading the same gossip far and wide.

    What is obvious, and has been for some considerable time is the fact that most of the senior management team are so far out of touch from reality they have no clue what goes on right under their noses. They cannot and will not ever listen to people who actually do the policing in the island and as such things will never change.

    I for one have no sympathy with Messrs Power or Harper. They both will be no loss to the island and have subsequently now revealed their true colours. Hopefully Mr Warcup will be successful in weeding out the middle management who from bitter experience all appeared to be adhering to the Mr Harper school of management.

    I can say though that people are still leaving the Force in droves. Could this finally be good Police Officers talking with their feet? Perhaps if they had been allowed to get on with doing their job and catching the bad guys instead of watching their backs from their own management team they would have stayed put.

    Still i can report that Policing the world over is not as politcal as it always has been in Jersey. In some Police Services they allow their Officers to work without being micro-managed and if you have a field of expertees, even despite of your rank, bosses listen to your opinion and past experiences and put it to good use. Maybe one day that novel approach will catch on on the other side of the world!

    I agree with Skippy, the Power/Harper School of Policing was terrible and it was the worst mistake Jersey ever made in bringing them over and shoving them into positions which were later confirned to be totally beyond them.

    I also have little sympathy for the supporters of these people either because their blog comments are not representative of the Jersey people but only representative of cowardly Syvret cronies who wouldn’t dare say these things under their real names for fear of law suits.

    It is time to move on and forget all this tireless scandal rubbish for good.

    his assistant minister appears to have been left out of important meetings and was unable to answer questions…

    suddenly the Police Chief is now suspended due to Operation Blast “AND” his handling of HDLG

    and an affidavit from the Chief of police is “not evidence”

    Many cops are also criticising the lack of courage and tenacity in the leadership due to the fact many of the middle management have little or no experience after so many retirements.

    This officer must have gone through a number of lengthy interviews, he would have researched Jersey, the SOJP, the current political and economic scene and then been offered and accepted a job.

    He (and presumably his family) would have had to be relocated, re-housed and (possibly) put his kids into new schools. The whole operation is expensive, time consuming and a logistical headache.

    It is disingenuous of Le Marquand to consider that he was frightened away by the possibility that he might, possibly, one day in the unspecified future, be critisized on an unspecified internet blog.

    In fact I consider it an insult to the public’s intelligence that Le Marquand even suggests it.

    The more those in government drift from the truth, the more they will hate and punish those who speak it – or Blog it! Needless to say, freedom of speech and expression must, whether or not they like it, be protected at all costs.

That said, may I remind everyone that this is the same wishy washy Minister who got up in the States Assembly last December and announced to his fellow members that it would be quite acceptable for the Police to be allowed to operate “outside of the Law”! Proof that this Island is in desperate need of an ‘Independent’ locally nominated and elected, Police Commission – either that or be prepared to live in a Police State where free speech is banned, if not stifled.

    Experienced policeman scared off by web blogs – I don’t think so ! …Do we look that stupid ?

    Two more credible possibilities strike me:

    Possibility #1: On arrival in Jersey it became crystal clear to him that he had to tow the Council of Ministers / “Communications Unit” line or kiss his career goodbye.
    Perhaps being uncomfortable with this and unwilling to be a “cab for hire” he decided to remove himself form the situation -smart chap.

    Possibility #2: Even more worryingly; On plunging into his new post he was able to make the judgement that there was a risk that a significant portion of the allegations and evidence on these blogs was actually on a firm basis.
    In the long term, being tainted by involvement could do his career even more damage than not being “on message” as required bu COM.

    Of the two I deeply hope that “Possibility #1″ is closer to the truth.

    We don’t deserve to be governed or policed like this.
    I look forward to the next elections !

    Coming from outside he could see it all – that Jersey Police & justice system is a farce. One law for ‘establishment’ and other for hard working people… Chasing ordinary bloke for petty offences (imposing big fines & threatening with custodial sentence) while big fish and seriously violent criminals walk away free…
    Taxpayers do not want to spend money for this sick system.
    (And promotion in Jersey Police should be done internally! I do not recall any Jersey policeman offered high rank job in Metropolitan Police)

    Paul Baker (49). Hello there. I’m Tony gallichan. I want to see an end to the corruption in Jersey. I’m not alone, either. It doesn;t always mean that we are ‘cronies’ of Syvret. i do happen to think he’s right, and has shown evidence time and again to prove it – evidence that his detractors ignore and say doesn’t exist.

    I’ve happily said I’ll go to court over any of this – To be honest, it needs a decent UK court case to get all this out in the open. The reason a lot of folks don;t use their real name is that, yes, they are scared. Not of law suits, but of losing their jobs, their careers, their homes. After all, thats the Jersey Way.

    I, on the other hand, say ‘Come and get me’.
    That’s ‘cos I’m lucky. I can’t be touched by those people who do things the Jersey Way…

    As for Superintendent Paul Kemp, well.. I think we all know the real reason why he left. The whole HDLG/ Power thing is blowing up. Home Affairs have no credibility, neither does Warcup.

    Of course, there are those who feed these type of comment boards with falsehoods and denials, as if all the suffering that those abused at HDLG and other places, doesn;t matter. It seems to be a game for them.

    However, all people have to do is read the proof. The ACPO reports. The Sharp Report. The minutes of Power’s suspension review meetings.

    Of would they rather it all fell through the floorboards like so many teeth?

    One could argue that the law fairly enforced and without fear or favour so that even the state itself is subject to the law is a cornerstone of a modern democracy.
    Perhaps Senator le Marquand as a lawyer and magistrte would like would like to explain how his duty to uphold the law is compatible with his belief that it is capable of being broken when it is expedient to do so.
    Obviously criminals have to be caught and convicted but it has to be done within the law, how else can the police and courts hold lawful authority?

    Ref “a decent UK court” : The crucial word is “decent” rather than “UK”. Most jurisdictions have a poor record of investigating and prosecuting
    historic abuse.and the UK is no exception. One problem is that it involves local authorities recognising and then investigating their own shortcomings – and almost inevitably putting themselves at risk of paying damages -not much of a motivation is it?

    Tony Gallichan # 66 – I wouldn’t hold your breath waiting for that to occur. I suspect much of the evidence is anecdotal and not admissible in a court of law.

    Historical abuse cases are notoriously difficult to prove, often with little corroboration and rarely any forensic evidence to help substantiate allegations of inicidents that occurred many years ago.

    Research has revealed a number of social and cognitive factors that can subtly influence and powerfully distort the perception, memory, and recall of an event. Furthermore in many cases the reliability of eyewitness accounts can be affected by suggestion and personal biases.

    By releasing too much information to the media, there is always potential for defence lawyers to infer that media hype assisted witnesses in inventing false accounts.

    It is my contention that Lenny Harper employed a flawed press strategy, which ex-Detective Superintendent Mick Gradwell recognised. I also imagine the now retired Detective Superintendent Paul Kemp saw the potential for major problems resultant of the earlier erronous press strategy. That may have been a contributory factor in him not wanting to take the now poisoned chalice.

    I have spoken to a number of recently retired and current police officers, who mostly all agree that the H de la G case was mishandled, but due to their professionalism they have not discussed specifics.

    Never in the field of policing has so much controversy been caused by so few. It will take many years to repair the damage this has caused.

    From my own experience I know that the Children’s Service and police have a history of vigorously investigating allegations of child abuse over many years. There is to my knowledge not one shred of evidence that officers intentionally swept reports of abuse under the carpet.

    When the claims of mass murders and ritual abuse at HDLG first hit the headlines it was a shock that such things could happen in such a small community without any rumour or report of any kind, and let’s face it in Jersey nothing happens and stays secret for very long. The impression I got in those early days from news reports and the interviews from Lenny Harper were that the Police investigation was being given top priority in resources and funding and the subsequent estimate of £12 million certainly supports this view. That no evidence of murders or mass graves were found after many months of digging and searching should have been the end of it and I cannot accept that there was some hidden agenda being played out by Lenny Harper. That by this time Senator Syvret had also jumped on the bandwagon, despite being the Minister responsible is no coincidence. Of course he was sacked but if he had had any integrity he would have resigned. The subsequent failings in the heath department and the resulting deaths are evidence that this was the correct decision should themselves disprove the conspiracy behind his dismissal to all but the most irrational mind.

    That both our Child Protection and our Health Service have made such huge leaps forward since his departure suggest that perhaps the problem was not the staff or the systems but down to a failing of the person in charge.

    That Senator Syvret has since fled to London, apparently in fear of his life from our all seeing, controlling and corrupt oligarchy is laughable. In one breath he accuses most States members of not being able to organise the proverbial party in Ann Street, whilst in the next they are some dark and sinister collection of the most genius and evil of minds successfully conspiring to control not only Jersey but also now the UK Government. Whilst I subscribe to the former both cannot be true. If he puts such fears aside and returns next month to collect his £40k perhaps may end the debate.

    Unfortunately the accusations made in his blog go far deeper than just insults. To publicly accuse, is seems EVERY person who has is some way upset or criticized him of such heinous crimes as child abuse and rape is not an expression of free speech. That he write his blog under his title of a Senator in the Jersey Government gives a perception of some legitimacy and I cannot not understand why it is that those so accused cannot sue his employer, that being us the Jersey tax payers as would happen if a Director of a major corporation were to make such allegations in the name of his Company. Indeed I think the States should either take responsibility for such conduct of one of their members, or remove him completely from post in the public interest. The comment that a perspective candidate for Chief Police Officer MAY have been put off coming to Jersey is in my opinion a very fair statement given the above. That Senator Le Marquand was not even a States member at this time must put his comment into perspective and further indication of just how desperate those conspiracy theorists whose only agenda appears to be the destruction of Jersey and our independence are to keep their cause afloat.

    Generally there are two sides saying largely contradictory things and it is just not possible for both sides of a contradiction to be true.

    Questionable practice in law is as old as the hills. There is even an ancient word for it -do a web search on “shyster; definition”

    Personally I would also like politicians to tell the truth and act with integrity – at least some of the time.

    As far as I am concerned until someone in authority disproves these allegations in an open and transparent way for all to see I will not dismiss then out of hand as some appear to be doing in the island.

    They have been given much more credibility IMHO by the fact that the person making them has used their own name and not hidden behind an alias.

    It is not for the reasons you cite. I suspect that you know that anyway but thought you were being witty.

    The Senator believes that he, and pretty much anyone else, cannot get a fair trial in Jersey because the system is not ECHR compliant, that is to say it is not fair and impartial, that corruption exists, that there is substantial blurring between the police, the judiciary, civil servants and politics, that there is a lack of equality of arms and that the legal aid system is dysfunctional and unfair.

    I am not sure that all of his claims are justified but I am convinced that some of them are.

    Examples include the AG’s various roles being a clear conflict of interest and, that a person is only entitled to have a lawyer present in a police interview if they can either pay for it or if they are accused of child abuse, rape or murder – which, as you will know, does not reflect the seriousness that the court attaches to offences at sentencing.

    Contrast the sentencing in a hypothetical case of a minor indecent assault on a child against a major drug importation. The former, who may spend a just a few months in prison, is entitled to have a lawyer present in interview i.e. full legal assistance, the latter, who faces many years behind bars, isn’t – unless he can afford to pay for it.

    A rich person will therefore get what he pays for. A poor person gets what he is given in a short telephone call to god-knows-who with god-knows-what experience. I don’t regard that as either balanced or fair.

    I don’t reckon it all boils down to people coming forward to clear themselves after 2 years of slander because how many people are we talking of here – 30/40? For them the proof is really all down to whether they have been charged with a crime since his accusations appeared and the fact of the matter is that not a single person has. The law states that people are innocent until proven guilty and not only does Syvret trample all over many peoples human rights but he cannot even come up with evidence to prove guilt when challenged to.
    So what does that say about the accuracy of his information and also the kind of people who regular join in on his blog then?

    Further to your post Adrian, The Chapman Report, in its introduction, said that it had “received information that led it to conclude that the Board was taking insufficient action to support employees who were suffering harassment and associated stress in the course of their duties; and, that as a consequence the Board might be failing to discharge its duties under Article 3 of the Health and safety at Work (Jersey) Law 1989″

    Chapman recommended that the SEB publicly, and extensively refute any allegations on the blog. So far we have seen precisely zero from SEB.

    It appears that far from ‘disproving’ these allegations, the authority responsible has not even refuted them! Why would the SEB be content to fail to discharge its duties under the law – unless it wasn’t failing to?

    It will make an interesting court case Matt.

    What outsiders looking in think of all this and that includes ACPO is the Million Dollar Question because I doubt anywhere else in the world has a ridiculous situation like this one.

    What other option is there? Allow poor people the right to choose the best lawyer in the world to defend them? And who would pay for that? I used to charge £400 per hour in private practice and that was 7 years ago: I would add 50% if I was required to sober up and get suited in the early hours. But if the Jersey taxpayer is willing to stump that up for some scroat off the boat, fair enough.

    Maybe you should start a petition called “Raise GST to fund better legal aid for drugs smugglers with no connection to Jersey”. Tell us how you get on.

    Well has no one noticed we seem to get all the off cuts from the British police force! now if your a big player in the police force and you have reached that special age where they offer you a cushy job rather than early retirement, lets say a nice job at a quiet police force in Jersey. All our head poice are old police officers from Uk forces. Why cant we get one from Jersey? are they not good enough, Can they not be trained. They dont’t need a golden handshake, a house and an extension on a pension. Come on guys Jersey isn’t a major crime hotspot. You will probably find it was the backward system over here and not the blogs that put him off. As said before he must be used to critism being a ex head English officer. We should have asked him if he wanted to run the fire service and look after animals, stuck children and maybe a small fire.

    Mr Pond. It is you who is wrong so I agree with your parish’s opinion. I hope you were never instructed on criminal cases.

    Whilst everyone is, technically, entitled to have a lawyer present at a police interview, under the legal aid scheme that is not the case.

    It is the Legal Aid scheme that I was commenting on and critisizing for being non-compliant with the ECHR.

    This is from Code C of the PPCE Law.

    “A person requesting legal advice shall be informed that the Duty Legal Representative Scheme operates between specified hours (as agreed by the Law Society) other than in exceptional circumstances where the subject has been arrested for a serious offence (for example, murder or rape). However, this does not prevent the person from contacting his or her own legal representative between those times at his or her own expense.”

    Don’t take my word for it, if you want confirmation of this just call the police station or the Acting Batonnier and ask them what the rules are.

    Since you ask, the other option would unfortunately be to comply with the European Convention on Human Rights, to which we have signed up, and place the obligation on the State to provide free legal assistance to all rather than on the law firms, who incidentally, have no obligation under the ECHR. That probably means that taxes would rise.

    The trade off would mean that people’s rights are protected. Not everyone who is arrested is guilty. That might surprise you Mr Pond, given your rather glib response.

    I can’t agree with your assertions that people can not get a fair trial in Jersey. Why don’t Mr. Syvret’s supporters start a fund to pay for his defence? If they are confident he would win then they’d get their costs paid back. I am sure there may be any one of a number of up and coming Advocates, who would love to make a name for themselves defending him – that is unless they believed it to be an open and shut case.

    I never did criminal work – I saw several hundred grand coming off my profit share as a result of me personally subsidising legal aid so I assumed it was OK. To be honest, the only people who would either want or be able to afford me would be those spending other people’s money.

    But what is the problem – if you are arrested for a serious offence you can get free (to everyone other than the lawyers) legal aid. If not, you just shut up until the morning. It’s hardly complex.

    And I would say 95, maybe even 100% of people arrested out of hours are arrested for a drink related offence. So they only get interviewed when they’ve sobered up anyway.

    And, to be controversial, I don’t think anybody has been banged up because of a lack of legal representation at the cop shop. I do think innocent people have been banged up (one high profile trial recently springs to mind and not necessarily the first one you think of) but the problem is in my view misdirection at the court level rather than lack of lawyers at Rouge B.

    Like I said in my post we must be the only place in the world who has a Senator using a blog to insult and slander Jersey people without even a fair trial. In any democracy there is no excuse for this behaviour from anybody never mind somebody who proclaims to be in politics for almost 20 years. Its embarrassing for Jersey and puts the Island‘s politics into disrepute.

    Just imagine if there were more politicians behaving like this and idiots joining in to match? Jersey would be an even bigger laughing stock than what it is now.

It is a shame this police officer felt the blogs were too much for him but most of us don’t even read em. Good luck to David Warcup he is the best man for the job and it would be even better if Mick Gradwell came back to help as well but we can’t have everything! By the way, these ACPO reports aren’t even worth the paper they are written on.

    Speaking as a retired Jersey Police Officer, and as one who transferred from the UK many years ago, I fail to understand the States Policy of importing these senior Police Officers from the UK who in my opinion, have no relevant expertise to offer Policing in Jersey and who block the upper ranks stopping local Police Officers gaining deserved promotion. I started here as a beat bobby locally, THAT is where you gain your expertise in Policing Jersey. The waste of taxpayers money used for importing these so called “experts” as this government is hell bent on doing for every other little local problem in the island, is damaging this Island’s economy.

    No, Don Move, you have no concept of “the real world”.

    If you commit a crime you either pay for a lawyer of your choice or you get given one. The one you are given may be funded by the State or by the legal profession. But you get a lawyer for free. He or she will be qualified.

    But it is an established fact that a successful corporate lawyer will generate significant fees for a law firm whereas a legal aid lawyer generates nothing. He will be the same “cost” to the firm whether he is the best lawyer in the world or the worst.

    So it is natural that any lawyer who is ambitious goes into corporate law. Those who are not bright enough to do corporate law or who have a burning desire to do criminal work go into criminal law.

    Or, to put it another way, can you name one recent partnership appointment at any large law firm in Jersey of a criminal lawyer?

    Almost all lawyers will tell you that criminal law is the most boring field of law because it never throws up any intellectual challenge. It is almost always, to be honest, stupid people lying to you about what they did when they were drunk beyond belief or have been caught red handed.

    So, “effective representation”? If you can afford it you can pay for one of the two or three criminal lawyers with a decent reputation in the Island. Otherwise you can make do with those who couldn’t cut it in any other area of law. That’s reality.

    I have to agree with Anon # 101. Policing in Jersey is different to policing in the U.K., with the necessity in Jersey for the professionals to cooperate with the Honorary Police, who in many instances have primacy over the States of Jersey Police. I imagine ex Senior U.K. officers find this a difficult concept to accept.

I doubt very much that Mr. Kemp has gone into hiding. I can think of many reasons that may have contributed to his resigning, none of which have even been considered on this thread, and I will not relay them, because it would be theorising and guessing, the same as all the rest of these posts have done, and seemingly what Senator Ian Le Marquand has done too. I would prefer to hear from Mr. Kemp himself, if he was willing to enlighten us all. Try a bit of real journalism JEP

What are these people on, surely even they can see the way Harper drove Haut de la Garenne it was one big ripping yarn from start to finish? It was even attacked in the courts and Power was supposed to be over seeing him. No excuse, no excuse at all for their diabolical work and I think ILM is in the right and the friends of GP and LH are just desperate now.

That is a UK officer looking for a tax efficient temporary career change in an idyllic location only to find the total rats nest of lies, deceit and dishonesty that have pervaded this entire investigation until someone retried and Gradwell had to try and make a silk purse out of it. Even then, too much for a proven detective, unlike Harper who knocked away the foundations of a good case on his amateur background

    A blog is no more than a soapbox – a platform for free speech and expression and must never be curtailed by the likes of yourself or anyone else because you do not like or agree with the opinion or the manner in which it is expressed. The more people stray from the truth, the more they will seek to destroy any opportunity for those wishing to speak out. If you don’t like or agree with what is being expressed, then you are free to either respond or walk away, especially if, as you say, it embarrasses you so much.

    Usually detectives play their cards close to their chests and are a little more circumspect than the guy you referred to. He went around bleating about his investigation and appeared like an egocentric megalomaniac relishing the limelight. It would have been far better if he varified the facts before presenting them.

    His actions are likely to have severly jeopardised any realistic chance of finding out whether there was any substance to the allegations that were being made.

    An accredited senior investigating officer, more conversant with up to date methods, would have done a better job. Detective skills are perishable
    and whilst Mr. Harper may have had successes earlier on in his career, we have come a long way since ‘Life on Mars’ or ‘Ashes to Ashes’ when accreditation was unheard of.

    Having read the most recent postings on this article, I am dismayed at the results.

    Other than a few well judged questions about what really went on with this police officer and why after only four days he felt he had to leave the island, the majority of the most recent comments seem to be a rabbit rantings about how terrible blogs are.

    Surely putting sworn affidavits, accurate transcripts of hearings and reports from independent scrutineers is no bad thing in the absence of a freedom of information Law, how else would the public find out – or am I missing something?

    As most people have not noticed in the report above, Ian LeMarquand believes it was bloggs that put the new superintendant off! This is the typical Jersey way! It has to come from the horses mouth before it becomes fact!
    Did the superintendant say this to anyone! NO, Did Ian Lemarquand have proof this was the fact! NO its all speculation. Normally speculation in a situation like this means there is a cover up of the truth! I would love to hear the real reason for his departure. I mean If Ian Lemarquand said in the report, i was told by the departing officer it was due to bloggs then fair enough, but if anyone can tell me where that is stated because i can’t find it.

    When we are selectively fed information by the authorities, and to some extent the local media, there is little option left but speculation and information published on blogs.
    Information that would OTHERWISE REMAIN HIDDEN and has probably been obtained and provided with very meagre resources.

    Ian Le Marquand, as the Home Affairs Minister, should have an interest in policing on the island – part of his job I would have thought !
    When the (proposed No2 most senior ?) police officer on the island leaves after 4 days Ian Le Marquand did not bother to find out why ???
    We are left in position of questioning his veracity or his competence (or both).

    When lawyers get involved it is would appear that it can be to the detriment of clarity and the truth (ultimately or immediately ?).

    The law can be a mucky business – I am concerned that perhaps wading in the cess pond too many years leaves one unable to smell something that is a bit iffy -and probably even stinks !

    I am glad “Helen Back” (120) made you laugh with her “speculation”; didn’t find it funny myself – perhaps you should get out more – maybe get some fresh air ?

If you want proper truthful reporting stick to media suppliers like this newspaper.     The world does seems a little awash with “conspiracy theories” at times.

    I have noted the use of the terms “conspiracy” and “conspiracy theory” on a number of occasions and it does have certain connotations.

    Because someone calls it a “conspiracy” or a “conspiracy theory “does not automatically make the “theory” untrue.
    All “theories” should be approached with scepticism and judged on their merits -and INVESTIGATED FURTHER IF WARRANTED.

    Most “conspiracy theories” perhaps originate and proliferate from sad individuals with a PC in a shed and no friends.

    Unfortunately IN JERSEY the “conspiracy theories” seem to emanate from (high ranking?) whistle-blowers in social services, previous poll topping and apparently highly principled politicians (soon to be ejected by the authorities?), serving politicians, Chief Police Officers and Deputy Chief Police Officers ……………………………………………………

    These Jersey “conspiracy theories” backed up by EVIDENCE that is made available from the web and is sadly lacking from the authorities and the symbiotic media.
    CONSTRUCTIVE INVESTIGATION seems to be obstructed and stifled by the authorities at every opportunity. Evidence (and individuals) are ignored or “poo-pooed” by the authorities but generally NOT EFFECTIVELY REFUTED.

    Oh Matt – engage your critical faculties – wake up and “smell the coffee” (Oh; that’s not coffee; it’ something far less pleasant and far more disturbing) – protect your island, it’s good name, or what’s left of it, and the vulnerable who are likely to continue to be at risk in this atmosphere that seems deep in denial and where dissent is not tolerated.

    Un-constructive labeling (eg “conspiracy” etc) is no substitute for proper debate or critical analysis of one’s own opinions (opinions which can be very difficult to critical analyse if one is already very deeply “INVESTED” in them).

    May I be so bold as to draw your attention to my last post #139 as it was probably stuck in the ether with the moderators while you were considering your own post #140. – perhaps I am clairvoyant knowing that “conspiracy theory” would be the next hot thread -No just serendipity I think.
    (On the subject of this being a moderated forum I would like to mention that one of my posts #64 was edited/truncated by the moderators and so lost some of it’s clarity)

    In case you are wondering I have nothing to do with “Team Voice” and yes I do have a job (if you feel that is relevant)

    I have never met, but I have some knowledge of just one of the individuals involved in “Team Voice” and interestingly they DO seem to have a job !

    I have come across the various web presences of “Team Voice” and I have to say they are quite impressive and well put together and hardly look like the work of a few “sad spongers”. These things take commitment (and yes, precious time) so hats off to them I say -even those not in gainful employment.

    Becky, you say: “Too true I am afraid Team Voice, too true!” – Your knowledge of “Team Voice” obviously far exceeds my own so perhaps you could enlighten us with robust and non-partisan information- obviously without falling foul of any privacy issues or “data protection” legislation -Wouldn’t want you “doing a syvret” !

    Yes I heard Senator Perchard and his put down. Not a clever thing to do when the elections aren’t too far away IMHO. Hopefully this will help him get deselected in the near future. No doubt if this happens some will think there was a conspiracy to get him out of the states!

    As per the A.C.P.O. reports it is good that one Senator can publish them on his blog for all to read (except for some who apparently refuse to read them), and it doesn’t cost Joe Public a penny either!

    The only concrete evidence that is in the public domain are the ACPO reports – and they support the actions of Graham Power and Lenny Harper. All other information has only been seen by a certain priviledged few and, actually, until that supposedly ‘damning evidence’ that even Graham Power has not been notified of, becomes public, it is in effect heresay (and therefore subject to conspiracy theories).

    By the way, it would be interesting to know how Senator Terry Le Main helped your family to get their housing qualifications (as you advised in a previous comment).

    “In the Sunday phone-in on bbc radio jersey a member of the public phoned in and was critical of the fact that Senator Breckon’s original proposition had been defeated. The caller then asked Senator Perchard if, in the light of the damning JCPC report, he now regretted voting against this proposition.

    If the response given by Senator Perchard is indicative of the attitude of those who voted “contre” then Senator Breckon stands zero chance of success, no matter how convincing his case.
    A transcription of the recorded interview was made and this is exactly what the Senator said in his reply.
    “Good morning … err … XXXX … umm … you really are a bit of a conspiracy theorist aren’t you really … umm … I hear you regularly on the radio and … umm … I am not quite sure what motivates you and … umm … I think you’ve probably got too much time on your hands and … umm … I think … err … like many people who are unemployed and on benefits you’d probably be better off getting a proper job and … umm … not having so much time on your hands to develop and … err … ”
    Unsurprisingly Christie Tucker stopped the Senator from continuing at this point so we will never know what further insults were going to be levelled at a member of the public who dared to question the wisdom of those who had voted aginst Senator Breckon’s proposition.
    Given the seriousness of this case, the response from a former minister for health takes the reputation of our decision makers to an all time low. I don’t hold out much hope for Senator Breckon’s chances.”
