Senator’s insult a breach of conduct

SENATOR Jim Perchard broke the States Members’ code of conduct by insulting a blogger who called into a radio programme, an inquiry has concluded.
The Privileges and Procedures Committee has found that the Senator broke the part of the code that requires States Members to ‘treat other members of the States, officers, and members of the public with respect and courtesy and without malice’.
On the BBC’s Talkback programme on 25 March, Senator Perchard insulted ‘Voice for Children’ blogger Neil McMurray, sparking three complaints to the committee.
On the programme, Senator Perchard said to Mr McMurray: ‘I think you’ve probably got too much time on your hands. I think like many of the people who are unemployed or on benefits you would really be better off getting a proper job.’
He then added: ‘I was not talking about everybody that’s unemployed or people on invalidity benefits. I was talking about Neil McMurray.’

What hasn’t come over in this is just how personally insulting this was to the person involved. Senator Perchard knowing the physical circumstances of the individual deliberately chose his words . Hopefully Neil through Team Voice will expand on this as it is should be in the public arena but it is up to him. Over to you Neil.

This daft citizens media does not know when its crossing the line and some of these States members are having to deal with cyber insults nobody has ever witnessed before.
Okay maybe Senator Perchard should not of told this caller to get a job but he obviously knew who he was talking to and it doesn’t read like an ordinary member of the public to me.

Perchard your only saying what the many of us are thinking however he could have expressed himself a little better. If your out of work regardless of the reason as so many people are naturally you have more time on your hands and there is no reason for it because this week is Help Charity week and I know when I was out of work several years ago and couldn’t gain a position through no fault only that there were no positions to be had I put a lot of my time into help the Parish. There are many things you can do with extra time and put that time to good use.
What Perchard defines as a proper job has to be established and nowadays it is no easy to gain any job but to claim that this is a breach I feel it a little harsh.Surely he is as entitled to his opinion as the rest of us Staes Member or not. I do believe the states has become far too personaland so many scoring points off each other rather than getting on with the job in hand.

I know 2 people who have both lost hands and they both hold down full time employment. In fact I also know of 2 people who are quadraplegic and they too both work.
I think it’s time that this was investigated. If this man is capable of chasing politicians all over the island with a video camera, then surely he is able to work.
That’s my tax money that’s being dished out needlessly here.
And if Senator Perchard is going to be bought to task regarding his comments, then surely Mr Syvret should be bought to the many many insults that he has delivered over the past couple of years.

There are people here making judgements on a man they do not even know. Firstly the person on the receiving end of Mr Perchard’s very nasty and personal comments has a disability. Furthermore that disability was as a result of an accident caused AT WORK!!
Just because he runs a Blog which is informative (more so than the local media), means that anybody is privy to a lot more than they otherwise would be, and for that he should be thanked.
Mr Perchard seems to have a penchant for opening his mouth and putting his foot in it which is not the way he should behave. He is another that should be got shot of.

So, expressing an opinion that a capable person should “Find better things to do with his time and should get a job and stop sponging off society ” is worthy of public censure to the Senator involved , whilst accusing people of mass murder, being rapists or worse being paedophiles is quite ok in the PPC’s version of good governance? What a sick society we live in.

The way this Island is going Neil may not have any choice but start looking for a job. People on benefits are now losing their GST food refund amongst other things like free pescriptions if you read the small print. Jimmy was only making a suggestion so fair play to him. I hate the fact it is an offence to say what you think! He has one hand but I dont see the problem here, by which I mean he should still be able to get a job as there are laws that prevent employers discriminating against him. If he has any issues file a complaint against the people who refused to employ him, obviously if they didn’t employ him for a valid reason.

Having listened to the programme, I was shocked at the attack by Perchard, he obviously felt cornered and like a rabid dog attacked in the most despicable way. He was after all talking to a member of the voting public, his employer in fact.
Combine this with the outrageous comments to Stuart Syvret, and the fact that he LIED about them, in my book it’s 3 strikes and you’re OUT !

But on the whole the Phone-in is taken up with a few people who don’t work and just moan so maybe it was time for a few home truths to be told! These Health conspriacy blog theories and Haut de la Garenne coconuts have gone beyond a joke and we are ALL fed up with it never mind Senator Perchard!

Now lets get this right. Stuart Syvret has even had the Chapman Report dedicated to the way he treats civil servants and members of the public yet he doesn’t even get a slap on the wrist by PPC. Yet a very well known blogger who has been harrassing Senator Perchard together with the ex-senator manages to get him ticked off after Senator Perchard rightly told the blogger to get a job on radio. How one sided can you get? And when is Syvret and his fellow blogger going to concentrate on Island issues that actually matter for a change and stop intimidating people with rubbish about Graham Power and the HSS? I read this morning yet more intimidating attacks on Senator Perchard, is this how the majority of Island voters want this Island run? Come on, come 16th June 2010 we can change all of this and get rid of Stuart Syvret for good! Now is the time to do something!

I listened to the radio programme and I thought the comments were uncalled for because they went straight into personal attack and it was made even worse because it was on live radio.
Anybody who knows Neil or spent anytime speaking to me will tell you that all he does is ask questions about events that either do not add up or do not make much sense. Nothing wrong with that and if you read most of the dozen or so other local blogs they are all doing something very similar.
But I cannot agree with what was said and the way it was put, frustration or not it was wrong.

it would appear that some of Syvret’s supporters are over egging the pudding here. Perchard’s comments are, in my view, perfectly acceptable. Publishing some semi-literate, partisan rant on a blog-site does not a journalist make. These so called “Citizen Media” types are just unemployed people with too much time on their hands. They might as well stay at home playing “Operation” and describe themselves as Surgeons. Jimmy is right, stop whinging and go and get a job.

Look if politicians cannot cope with direct public questions with a camcorder then they shouldn’t be in the job and there are some genuine questions emerging from some of these blogs from both sides which remain unanswered and what is wrong with asking questions about them? If we have a scenario where people say, “oh you cannot ask that”, then we may as well all be living in North Korea.
I am not taking any sides here I am just saying that I thought the radio outburst was a step too far and PPC have acknowledged that so do not start having ago at me because I just so happen to think the attack on Neil was out of order. I am sure it may take two to tango but then again two wrongs do not make a right so shove it if you do not like my take on it all… Grrrrrrr!

The whole point of being a statesman is that you don’t stoop to whatever is thrown….Perchard tried coming over on the radio as a smart ass…that is not what is required…can you imagine,”well Barak old chum ,we had a dissenter on local radio,but I soon told him where to get off,lazy git” one of the most glaring problems of this Govt is it’s dysfunction and gutter level behaviour of those placed in positions of trust.

Having read the VFC website, not all of it but a lot of it this evening I have not found anything on it that shows an attack on J Perchard as opposed to the one he makes on the bloke blogging his own view.
I didnt see one exerpt where he slags him off in such distain as Mr Perchard did to him. Fair enough moan about Stuart Syvrets slagging off of people, thats what he does but this Neil bloke hasn’t stooped to that level at all.

A serious question to all who would accuse SS of worse….why has he not been taken to court for such….? and why has no one challenged him at the hustings about such…methinks those who bitch about him should put up or shut up,had I been libeled or berated unfairly I would have done so,and please not the it’s not worth it he’s skint excuse for if all the so called outrage and hurt feelings are genuine the size of any claim would be irrelevant…….No I did not think so….he may well be irksome and an irritant to some with delicate feelings…but boy does he have staying power and not afraid to challenge the COM which let’s face it are crumbling as the real cracks appear even if the core establishment clones close ranks for TLS the rest of us see him for what he is and know the game is up…Jersey deserves so much better representation….

I think Perchard has got “balls” he is one of a few politicians who actually speaks his mind and says what he feels.
I remember when Perchard wrote to the JEP about cyber bullies! You will remember that he took some flak for that letter on the blog sites, especially on the Syvret blog !
Did he have any support from his colleagues in the states? Well if he did they kept quiet and hid in the shadows probably because they were scared, as they didn’t, themselves want to become victims of Syvret’s blog. They were bullied and were cowardly in response.
Perchard has courage and I salute him. If I were in the trenches and going over the top, he is the sort of guy I would want to cover me and on my side.

I heard the phone-in that day. My recollection is that the caller rang and ranted on and on. Kirsty eventually told him to ask a question. Senator Perchard accused the caller of being a conspiracy theorist and that he seemed to have to much time on his hands and that he would be better off getting a job.
Blunt, yes but put this in perspective. This was a political phone-in.

I have always, until now, had difficulty understanding how a small and chaotic “Workers’ Party” in the early 1930s, with no coherent policies, could have so successfully intimidated opponents and crushed dissent, in one of the (historically) most civilised nations in Europe.
Reading the self-styled “citizens’ media” blogs, over the past year or so, has given me a chilling insight into how that process must have worked. Only the technology has changed.
I am very far from being a fan of Senator Perchard’s, but PPC have made themselves look ridiculous by picking on this trivial matter, while studiously ignoring infinitely bigger targets.

It seems that Mr McMurray can dish the dirt but can’t take it. He was moaning on the radio the other week how disgraceful it was that he and Stuart Syvret were being bullied. I laughed so much I nearly choked on my sandwich.
Perhaps Mr McMurray could actually explain why he cannot work. Yes he has a physical disability but then so have many other people in full time work. He may not be able to do manual labour but there are plenty of other roles that he could fill. He can operate a video camera, use a key-board and drive a large four wheel drive so again I ask, can he please explain why he cannot work.

Any civilised society should provide for the weak, vulnerable and infirm. However, with an ageing population this philosophy will become increasingly demanding on the public finances. This is why, if persons are able to contribute to society, rather than sponge off the taxpayer, they should be expected to do so. Give and not take.
If people are partially limited by their ability to work because of illness or disability they should be expect to receive partial support.
This all or nothing system is bonkers.
The system should encourage people like Neil (who is extremely capable) back to work.
It’s not only morally wrong to take funding from society what should be spent of those who are genuinely needy, it is not affordable any longer.
Benefits and financial support must be targeted at those in genuine need.

58 the voice…Happy to answer any questions really….it is not so much a case of choosing from this sadly polluted bunch…though there are some of whom I actually admire and support…the old boys club is what must go…the way elections are rigged to keep the ruling elite in place is flawed and not fair…what would be fair is a reform designed on open fairness….the removal of situations where one minister can overrule an entire planning committee in favour of a fellow politician for instance….any autocratic situation works against the people..we also need a proper constitution..based on true values, honesty and good standards…it would serve to ensure correct behaviour and guard against all these personal agenda’s and deals for the old pals act.we currently have a dodgy group who are using our money to ensure continued secrecy…if secrecy is the prime concern it is because dark agenda’s are rife that and can only lead to an even more totalitarian state,where if someone does not like you…you can become an enemy of the state…and we all know where that leads…dawn raids by rabid police,privacy violation,search and seizure..no warrant nescessary.need I continue…rules and good order are too important to leave to personalities in a world with plummeting standards….a constitution is insurance against the codeless materialistic power brokers, bullies and grabbers.we need a govt that we can trust and therefore respect,you’d think they’d know that and behave accordingly..so it show’s how omnipotent the personal agendas have become.so the COM have become no more than a gang of like minded wealthy boys…and get all affronted when they are called Gangsters.such feigned righteousness is puke making to the average person.

Similarly to what you write -the Old age pension will not be able to be paid to all 65 yr olds in the future.
We are an ageing population and we are living longer. People at 65 are young and at 65 one can still do great things in the work place.
So people who can contribute like fit and able 65, 66, 67 yr olds, the likes of Mr McMurray who don’t seem to want or expect to work should be encourage through a mechanism of reducing benefits if they fail to accept work offered.

67 the voice…the old boy club..just take the collective of constables who despite their protestations to the contrary pretty much vote en bloc….are hopelessly enmeshed..so what you are asking is I choose from those there..and I am saying I would not choose many as the system within which they currently are demands that they capitulate with one anothers agendas…so unless they are freed by constitution they remain compromised…If you are determined that the question remains unanswered I can only assume you want to….most followers of local politics who understand how the game works will completely understand…I would not want what is presently there as the theme of the old boys network remains the same whoever is there..let me give an example Juliet Gallichan came in being a bit of a girl for the people in her image…look now.establishment through and through..so much so Tadier quit the privliges and procedures committee as she will not censure any of the aforementioned…need i say more…?

What is your take on Juliette Gallichan and her PPC lot, not having taken against Syvret when he was in politics? Do you agree that his outbursts, lies and comments on “the Vile blog” were obscene and disgraceful and that PPC should have delt with him ?
Why report on Jimmy Perchard for telling a bloke to get a job ?
My view for what its worth is, that the PPC is incompetent, pathetic and should be removed by states members asap.
I talk to many elected members and am reliably informed that PPC are a laughing stock amongst States members and officers of the States.
I was with 3 Ministers recently who just shruged their shoulders with a grin and said “what do you expect from the likes of Mike Higgins, Ben Fox and Colin Egre?”
These three titans of judgement are sat on by Juliette Gallichan as Chairperson !!!!
They bring our government and States into complete disrepute.

70MM I could not add much to your appraisal of ppc..either they have teeth or not and it seems not…Perchard did not simply tell the bloke to get a job ..it was a deliberate put down…unseemly and conduct unbecoming while on the media..imagine a loose canon like him on national T.V. ..you need to be able to conduct yourself in interviews etc…and say what you like about SS..he kicked Frank’s butt on Paxman..so it’s about Perchard’s clumsy public appearances and attitude not so much whether some phone in guy has or has not a job..disasabled or otherwise…now remember the channel T.V. interview with Perchard after the “Top yourself” outburst in the chamber..it was as cringeworthy a piece as one would dread..I do not want him representing me…and if people are going to lie then at least make it look convincing…he was not.

An explanation is certainly overdue as to why the States and PPC have failed to protect States members, employees and members of the public for so long from the appalling accusations, insults and provocations from the likes of McMurray and others who seem intent to misuse “blogs” as a vehicle to attack others. Equally Ex Senator Syvret and his supporters seem to think that PPC have already gone to far in curbing their right to “free speech”.
What does appear to have been established from the comments above is that at least Senator Perchard is honest in his comments and that perhaps politicians should be encouraged to call a spade a spade. Well done Senator Perchard for having the guts to expressing publicly the opinions of the majority of Islanders who voted for you.

I stopped taking any notice of this blog trash after reading insults against others because its attention seeking, but what gets me is how can Stuart Syvret even have the face or even the bottle to stand at the hustings amongst people he has done this to? Talk about double standards and I shall not be voting for him for this amongst multiple other things that have annoyed me.

The hustings last night was a joke. Syvret says that only he can change the States well dream on, because he has had 2 decades to do this and from where I am standing he can’t and to add to it the insults on his blog against other candidates are just getting worse.

Syvret’s blog is indeed getting worse. He, and his supporters are actively looking for any dirt that can be dished up on anyone who does not agree with them. They seem to have no regard for the families of the people they trash. Will they keep on until someone cannot take any more, and a tragedy occurs.Of course Syret will accept no blame. He never has done, or ever will. He insists on saying how brave he is to give up his seat in order to bring about this by-election. He did not give up his seat, he lost it because he ran away to the uk to avoid a court hearing. How brave was that!

I see McMurray has a video on his blog of someone moaning about how the island doesn’t do enough for them. She claims that her rent is £133 a week and her living conditions not good enough. What is wrong with these people. Why can’t they get jobs and support themselves instead of just sitting around all day whinging and expecting hand outs from the states.
On top of the £1300 a month I pay in rent for me and my son to live, I have to fork out about £400 a month in taxes, most of which probably goes to support these people. Makes me sick!

Mr Syvret is now a one man act because all progressives have turned against him in this election by standing against him which he did not expect. Thats why the blog is becoming more bitter and twisted than ever because they have messed up his job prospects.

Why oh why do you read his blog if it narks you so much..? and as for insults..and the attendant sensitivity to them, I have never known a community so obsessed with what other people think or,heaven forbid ,might think, why..? get over it.anything said about me is either true or false..if it is true then maybe I should address it..if it is false ,why would I give it head room.resentment is letting someone occupy your mind rent free,now at least as good Jersey citizens you surely would not want that …would you..?

I’ve never really sat firmly on either side of the fence when it comes to Stuart Syvret. I have always admired the passion that drives the man to stand up to the old boys network, but at the same time have questioned the sanity of doing so in what is clearly a no-win situation. If there were a dozen SS’s in the States, we may have seen some radical change years ago, but the records show that anyone who has tried to rock the political boat in Jersey has nearly always been beaten down by the ‘fathers’ of the island. It’s no wonder the poor man has become paranoid and has been driven half mad by it all.
I often wonder how some of the more recent additions to the States who have a bit of an edge to them – mostly listed in Post 83 above and in particular Ben Shenton, would have faired had SS not paved the way for them. Ben, like his father, is a great politician and not afraid to reveal the truth, no matter how ugly it may be, but it has to be said that he probably only ‘gets away with’ much of this because of who he is and the fact that most things pale in comparison to anything that SS happens to be up to at the time!
As for commenting on this news story… Jim Perchard is a farmer trying to be a politician. Tact was never one of his greatest assets so what can you expect? No matter what the background to the argument, if, as an able-bodied man in a position of authority, he sees fit to publicly criticise a disabled person, he has to live with the consequences. But then Terry Le Main has a history of putting his foot in it in this way, yet it always seems to have been magically swept under the carpet and forgotten about within days, so I’m sure Jim will be giving him a call for a few tips on this one over the next few days.

I see Syvret differently now in that he could never keep up with the people around him in the States after 20 years so he resorted to becoming a trouble maker instead and I seriously doubt the accuracy of everything he says now, actually I dissmiss it all. You cannot deny it and you have to ask yourself this, if the Island was run by blogs and his especially was so bang on with accuracy then why hasn’t anybody ever been charged for anything he claims and why doesn’t every States member run one seeing as they have such a captive audience? The blog world is Syvret’s downfall, yet he carries on as if nothing around him is happening.

no 83 thank you for your answer even if i had to ask the question three times i found your selections very interesting but could i ask what you mean by personal expense.having read your article on over spending quangos cival servents and tax of which the majority of your comments i agree with i find it very strange to find the name of m.higgins there as it was not so long ago that he was suggesting that jersey should borrow money to pay for things that we needed to do as far as i am concerned not something i would like to see.how about you.

93.By personal expense I do not mean £££ but in Flak taken,I think you’ll find that while money was cheap to borrow.M Higins thought it imprudent to pay for the incinerator debacle in one go,and keep some liquid dosh available…other than that like you I agree we should live within our means….something Roy Travert warns about. Hope he rolls out for election next time..would be a great candidate,plain speaking,honest and very smart.
