Third party appeal disallowed

NOIRMONT residents who lost a seven-year battle to protect a green field from development have been told that they cannot appeal against Planning’s decision.

Last month developer David Sheppard was given outline planning permission to build one house on field 621, which is in the green zone, between Woodbine Corner and the road to Ouaisné.

Planning had previously refused all his applications, but reversed their decision after Mr Sheppard lodged an appeal in the Royal Court and they knew they could not afford to fight him in court.

Andy Thompson, the next-door neighbour to the field, wanted to lodge a third party planning appeal but has been told by Planning that he cannot do this.

    This is a case of one unpleasant developer with deep pockets Vs. a bunch of selfish nimbies who’ve all got their own nice big houses in the countryside already (thank-you-very-much) and don’t want anyone else moving in nearby. It’s only a pity that they can’t both lose…

    In the end, however, I think that the right decision has been made. Whatever your views on David Sheppard (and I don’t care for him myself), he did buy Field 621 when it was zoned as ‘Built-Up Area’ and so therefore he would have had a reasonable expectation of being able to develop the site – and the same would be true for any of us (were we to have had the money to buy this site).

    The residents who live along Route de Noirmont need a reality check. It’s not as if their lives would be ruined by the presence of one extra house in their area – life’s too short to devote years to fighting this kind of this…get out there and enjoy life and stop being so bitter about it.

    Why should we be at all surprised at Mr Sheppard’s unique way of doing business , as at Janvrins farm ( remember that) he knows exactly how far he can push the rules and regulations of the planning department but hey this is Jersey !

    There is only fair justice if you have the money to pay for the third party appeals as they have made it quite impossible to do so unless you have plenty time and also plenty money also its so unfair to limit the time for the appeal what happens if your on holiday when it arrive and it only ever arrives on a Saturday so from there post you have they ssy 14 days in my oppinion you loose 4 days straight away Saturday and Sunday so that leaves only !0 days and to download the forms you need to have IT skills we haven’t all go that god help the ones that have not

    Stand up

    Dont give up Andy Thompson – seek legal advice. Planning cant stop you appealing – its your legal right to do so (to refuse to allow you to appeal would breach Art.6 European Convention of Human Rights).

    Seek justice – never rely on what you are told by the Planning Department.
